The Failure of the 28-Clause Ceasefire Plan for Ukraine: Why Peace Negotiations Continue to Stumble

Europe breathed a deep collective sigh of relief on Monday, as the diplomatic emergency triggered by the announcement of a new 28-point plan for achieving ceasefire appeared – momentarily – to have been contained. A Washington representative spoke of "significant advancement" after Ukraine-US talks in Geneva. On Monday night, Russian leadership made its retaliation: an extensive attack of aerial bombardment on Kyiv.

The Cycle of Peace Talks and Military Action

The sequence of opposing developments captured the harsh reality of the outgoing year. By day, negotiation efforts are fought: optimistic declarations are released from multiple capitals. Significant resources is expended on containing certain initiatives. By night, the Kremlin forcefully demonstrates the world that, for them, conflict continues to be the key method for achieving "resolution".

Nighttime Reality

As military strikes unfolded into the early hours of Tuesday, the current condition of Ukraine's vulnerability was exposed. Ukraine is able to track projectile deployments from across the border, a ability provided through current data. From vantage locations, Ukrainian air force fighter jets that had been dispatched to counter approaching guided weapons roared overhead – sophisticated military planes provided to Ukraine by European allies.

Shortly after, Kyiv's air-defence systems activated: several firings targeted at a hostile projectile. This was a modern interception technology at work, probably delivered by allied countries. Every launch creates sudden vibrations, causing tremors. The instant of fear quickly transforms into grim resignation: maybe the approaching threat won't hit its mark this time, protecting urban areas from catastrophe and another blackout.

Continuous Dangers

Not long after, a heavy machine gun fired at a aerial vehicle somewhere nearby, part of a mobile-fire group – probably imported technology. Sadly, the bullets missed the hostile drone – it pressed on overhead toward its target.

Periodically, this persisted until dawn. Kyiv faced the daybreak reports: multiple fatalities, damage and infrastructure problems in multiple buildings as a result of the nocturnal offensive. As customarily, everyone still went about their day – experiencing conflict. But those entire period demonstrated Ukraine's essential dependence on international aid – a reliance that European nations are clearly incapable to substitute in the near term.

Unsuccessful Negotiations

The detailed framework from Washington sparked intense emotion, debate and profound anxiety – and briefly redirected concern from Ukraine's largest corruption scandal in years. Yet, we have experienced comparable situations, after earlier high-level meetings and bilateral conferences.

Every new approach from US leadership unfolds according to the same pattern: a political offensive against Ukraine, which Kyiv, with other European capitals, succeeds in resisting. They stabilise the situation but never actually achieve victory. This pattern will, no doubt, persist.

Tactical Assessments

It is tempting to accuse certain parties of repeatedly advocating Kremlin's demands. But that does not seem to be the entire situation. US administration operates on a assumption familiar among seasoned negotiators: you cannot achieve through diplomacy what you have failed to defend militarily. The White House presumes that it is impossible to pressure the Kremlin to abandon the areas that it presently holds in Ukraine's occupied territories.

The problem is that while accepting these circumstances, American administration does nothing to discourage Russia, through words or deeds, from assuming that the status quo will not shift further in its benefit in the near future.

Opposing Positions

Therefore, the Kremlin is convinced that duration works to their advantage – that Ukraine and its partners are nearing depletion. Their reason to accept conditions that does not give them the maximum possible gain is almost completely absent. There may be many attempts to stop fighting, but they will continue as long as Russia's leadership remains completely certain in the conclusion.

On the contrary, Kyiv believes that Ukraine can still endure, progressively conceding civilians and areas but averting a entire defensive failure until conditions improve in its favour.

Existing Situation

Factually, there are no genuine requirements for a truce. Now, subjective factors are coming into play: leadership ambitions to negotiate peace and secure international recognition, and Kyiv's dual difficulties – on one hand, not to alienate a key ally, and on the other, to rally Ukrainians around the country's interests against any initiative Kyiv finds unacceptable, so that their focus does not switch to internal issues. And although their mission will now be significantly challenging after current events, it remains very improbable that this will alter their fundamental strategy.

These two forces are influencing discussions.

Summary and Prospects

It took a only one week to terminate the suggested clauses of the current initiative. Aggressive and erratic handling of the matter by Washington, opposition by Ukraine and the remaining European nations, along with pacifying measures of diplomats, and finally, latest revelations, all achieved their purpose.

While new initiatives based on previous concepts are imminent, Kyiv, London and other allied nations should draw one fundamental conclusion: Ukraine and Europe will only be able to resist negotiation assaults from Washington that are rooted in Kremlin requirements and demonstrate particular unwillingness to change the course of events, if they maintain solidarity and improve their protective measures at a much faster pace. If they do, no combination of diplomatic or military actions will be able to defeat them. In the meantime, Ukraine's capacity to defend against evening bombardments will, for the predictable period, largely rely on ongoing international assistance.
